Introduction
You will find below the General Conditions of Sale of JH-IT Services (Herolove), located in Quenast. These General Conditions always apply if you use or place an order via our website. The general conditions contain important information for you as a customer. Therefore, read this carefully. We also recommend that you save or print these general conditions so that you can re-read them later.
Article 1. Definitions
1.1. Herolove: JH-IT Services mentioned above.
1.2. Website: Herolove's websites, viewable via www.herolove.be and all associated subdomains.
1.3. Customer: the natural person who does not conclude a Contract with Herolove and/or has registered on the Website, not acting professionally or commercially.
1.4. Agreement: any agreement or agreement between Herolove and the Customer, of which these General Conditions form an integral part.
1.5. General Conditions: these General Conditions.
Article 2. Applicability of General Conditions
2.1. The general conditions apply to all offers, contracts and deliveries of Herolove, unless otherwise expressly agreed in writing.
2.2. If the customer includes in his order, confirmation or acceptance notification provisions or conditions that deviate from or are not included in the general conditions, these are only binding on Herolove if and to the extent that they have been expressly accepted by Herolove in writing.
2.3. In the event that product or service-specific conditions also apply in addition to these General Conditions, these conditions also apply, but in case of contradictory conditions, the Customer can always invoke the applicable provision that is most favorable to him.
Article 3. Rates and information
3.1. Unless otherwise stated on the website, all prices indicated on the website and in other documents from Herolove include VAT and other government levies.
3.2. Unless otherwise stated, shipping costs are €5.50. If the total order amount is over €50.00, delivery is free. These costs can also be viewed on the website. In addition, these costs will be clearly displayed during the ordering process.
3.3. The content of the Website has been prepared with the greatest care. However, Herolove cannot guarantee that all information on the Website is accurate and complete at all times. All prices and other information on the website and in other documents from Herolove are therefore subject to obvious programming, typing or spelling errors.
3.4. Herolove cannot be held responsible for (color) deviations due to screen quality.
Article 4. Contract Conclusion
4.1. The Contract is concluded at the time of acceptance by the Customer of Herolove's offer.
4.2. If the Customer has accepted the offer electronically, Herolove will immediately confirm receipt of acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Customer has the possibility to terminate the Contract.
4.3. If it appears that when accepting or concluding the Contract, the Customer has provided incorrect information, Herolove has the right to fulfill its obligation only after receiving the correct information.
4.4. Herolove may inquire, within the legal framework, about the customer's ability to fulfill his payment obligations, as well as all facts and factors important for a responsible conclusion of the contract. If Herolove has good reasons not to conclude the contract based on this investigation, it is entitled to refuse an order or request with justification, or to attach special conditions to execution, such as advance payment.
Article 5. Registration
5.1. In order to make optimal use of the Site, the Customer can register via the registration/account connection form option on the Site.
5.2. During the registration procedure, the Customer chooses a username and password with which he can log in to the Site after registration. The Customer is responsible for choosing a sufficiently reliable password.
5.3. The Customer must keep his login information, username and password strictly confidential. Herolove is not responsible for misuse of login information and can always assume that a Customer who registers on the Website is indeed that Customer. Everything that happens via the Customer's account is the responsibility and risk of the Customer.
5.4. If the Customer knows or suspects that his credentials have fallen into the hands of unauthorized persons, he must change his password and/or notify Herolove as soon as possible, so that Herolove can take appropriate measures.
Article 6. Contract Execution
6.1. Upon receipt of the order by Herolove, Herolove will send the products to the address indicated by the Customer, in accordance with paragraph 3 of this article.
6.2. Herolove has the right to engage third parties in the execution of obligations arising from the Contract.
6.3. Herolove will try to deliver the order the next day if the order is placed before 6:00 PM on a business day. However, Herolove cannot guarantee that the order will be received the next day, as Herolove depends on third parties for this. The delivery times indicated by Herolove are not binding. The delivery method can take place in different ways and is at Herolove's discretion.
6.4. If Herolove cannot deliver the products within five business days, it will inform the Customer. In this case, the Customer can agree on a new delivery date or has the possibility to terminate the Contract free of charge.
6.5. Herolove advises the Customer to inspect the delivered products and report any defects found to Herolove within a reasonable time, preferably in writing.
6.6. As soon as the products to be delivered have been delivered to the indicated delivery address, the risks related to these products are transferred to the Customer. Unless expressly agreed otherwise, the risk will be transferred to the customer more quickly. If the Customer decides to collect the products, the risk is transferred upon transfer of the products.
6.7. Herolove is not liable to the Customer if he has used a delivered product in a manner other than recommended, prescribed or for which it is intended.
6.8. Herolove has the right to deliver a similar product of similar quality to the ordered product, if the ordered product is no longer available. The Customer then has the right to terminate the Contract free of charge and return the product without cost.
Article 7. Right of withdrawal
7.1. The customer has the right to terminate the distance contract with Herolove free of charge within 30 days of receiving the product, without stating reasons.
7.2. The period runs from the day after receipt of the product by the Customer, or a third party previously designated by him, who is not the carrier, or:
- if the Customer has ordered several products in one order: the day on which the Customer, or a third party designated by him, received the last product;
- if the delivery of a product consists of several shipments or parts: the day on which the Customer, or a third party designated by him, received the last shipment or last part;
- in the case of agreements for regular delivery of products for a certain period: the day on which the Customer, or a third party designated by him, received the first product.
7.3. The customer must bear the return costs himself. If these costs exceed the usual postal rate, Herolove will provide an estimate of these costs. The shipping costs incurred by the Customer when purchasing the products will be refunded when the Customer returns the complete order. When the Customer returns part of the order (and keeps another part), shipping costs will remain at the Customer's expense. The customer must report the return via the contact form indicating the order number. The customer will receive a label within 5 business days
7.4. During the withdrawal period referred to in paragraph 1, the Customer will handle the product and packaging with care. The customer will only open the packaging and use the product to the extent necessary to check the nature, characteristics and functioning of the products. The basic principle here is that this inspection cannot go further than what the Customer would do in a physical store.
7.5. The Customer can terminate the Contract within the deadlines set in paragraph 1 of this article by sending the (digital) withdrawal form template to Herolove, or by making it known in another unambiguous way to Herolove that he renounces the purchase. In case of digital notification, Herolove will confirm receipt of this notification. After dissolution, the Customer has 14 days to return the product. It is also possible to return the product immediately within the reflection period specified in paragraph 1 of this article, provided that the withdrawal form template or other unambiguous withdrawal statement is attached.

7.6. The amounts already paid (in advance) by the Customer will be refunded to the Customer as soon as possible, but at the latest within 14 days after termination of the Contract, in the same way as the Customer paid for the order. If the Customer has opted for a more expensive delivery method than the cheapest standard delivery, Herolove is not obliged to refund the additional costs for the more expensive delivery method. Unless Herolove offers to collect the product itself, Herolove can wait for the refund until Herolove has received the product or until the Customer demonstrates that he has returned the product, whichever comes first.
7.7 The website clearly indicates, in good time before the conclusion of the contract, information on the applicability or not of the right of withdrawal and on the desired procedure.
7.8. The customer has no right of withdrawal when it comes to products that cannot be returned for health protection or hygiene reasons and whose seal has been broken after delivery.
Article 8. Payment
8.1. The Customer will have to make payments to Herolove according to the payment methods indicated in the ordering procedure and possibly on the Website. Herolove is free to choose the payment methods offered and these can also change from time to time. In case of payment after delivery, the Customer has a payment period of 14 days from the day after delivery.
Article 9. Warranty and Compliance
9.1. This article only applies if there is a Customer who is not acting in the exercise of his profession or business. If Herolove grants a separate warranty on products, this applies to all types of Customers, without prejudice to what has just been indicated.
9.2. Herolove guarantees that the products comply with the Contract, the specifications indicated in the offer, reasonable requirements of reliability and/or usability and legal provisions and/or government regulations in force on the date of conclusion of the Contract. Subject to specific agreement, Herolove also guarantees that the product is suitable for other than normal use.
9.3. If the delivered product does not comply with the Contract, the Customer must inform Herolove within a reasonable time after discovering the defect.
9.4. If Herolove considers the complaint founded, the products concerned will be repaired, replaced or refunded after consultation with the Customer. In accordance with the liability article, the maximum compensation is equal to the price paid by the Customer for the product.
Article 10. Complaint procedure
10.1. If the Customer has a complaint regarding a product (in accordance with the article on warranty and compliance) and/or other aspects of Herolove services, he can submit a complaint to Herolove by phone, email or mail. See contact details at the bottom of the General Conditions.
10.2. Herolove gives the Customer a response to his complaint as soon as possible, but in any case within 2 days of receiving the complaint. If it is not yet possible to give a substantive or definitive answer, Herolove will confirm the complaint within 2 days of receiving the complaint and indicate the deadline within which it intends to provide a substantive or definitive response to the Customer's complaint.
10.3. The Customer who is not acting in the exercise of his profession or business can also file a complaint via the European dispute resolution platform, accessible at https://ec.europa.eu/odr/.
Article 11. Personal data
11.1. Herolove processes the Customer's personal data in accordance with the confidentiality statement. This can be found here: privacy policy.
Article 12. Final provisions
12.1. The Contract, these general conditions and any agreement arising from the Contract are governed by Belgian law, unless other law is applicable based on mandatory rules.
12.2. If a provision of these general conditions proves invalid, this will not affect the validity of the entire general conditions. In this case, the parties will determine one or more new replacement provisions, which will give form to the intention of the original provision as far as legally possible.
12.3. In these General Conditions, "in writing" also includes communication by email, provided that the sender's identity and the integrity of the email are sufficiently established.
